Bankruptcy Options
Filing for bankruptcy is a tool for debt relief. I specialize in representing individuals and small businesses as debtors in Chapter 7, Chapter 12 and Chapter 13 bankruptcy cases in Idaho and the Eastern District of Washington.
Personal Bankruptcy
Chapter 7 and 13 (they’re called “chapters” because they’re named after a chapter in the U.S. Bankruptcy Code) are personal bankruptcies. They are used for individuals who have a lot of medical, credit card, or other consumer debt.
Chapter 7 is usually the quickest path to a fresh, financial start. It’s a “liquidation bankruptcy.” If you own property that isn’t protected by exemptions, it must be sold to pay toward your debt. However, many assets are protected by exemptions. A Chapter 7 case usually lasts 4-6 months with dischargeable debt eliminated within 3-4 months of filing. A Chapter 7 bankruptcy can stay on your credit report for up to 10 years.
Chapter 13 helps you reorganize your debt and puts you on a repayment plan. If you make too much money to qualify for Chapter 7, filing Chapter 13 is a viable option and can help you avoid selling non-exempt assets.
Business Bankruptcy
Businesses often utilize Chapter 11 bankruptcy to restructure and get out of debt. Chapter 7 can also be utilized by businesses, but this is usually when a business is shutting its doors.
Bankruptcy for Farming & Fishing Operations
Chapter 12 offers an option to farmers and commercial fishing operations. It can help you reorganize your debt without having to go through the more expensive Chapter 11 process.
